A lawsuit has been filed in Asheville challenging a North Carolina law that allows magistrates to opt out of performing same-sex weddings. The lawsuit was filed by a team of attorneys who also took on the state's constitutional amendment that limited marriage to one man and one woman. It was overturned by the same judge that will hear this case: U.S. District Judge Max Cogburn.
The attorneys are arguing that Senate Bill 2 is unconstitutional. The bill was passed by the republican-dominated legislature over the objections of democrats and republican Governor Pat McCrory, who unsuccessfully vetoed it. One of the attorneys challenging the law is Meghann Burke of Asheville. She spoke with WCQS's Jeremy Loeb.
One of the sponsors of SB2 was republican Senator Jim Davis of Macon County in western North Carolina. In an earlier conversation with Jeremy Loeb, he defended sponsoring the bill.
